Acceptable Use Policy

This Acceptable Use Policy ("AUP") indicates the actions of SG MANAGED users that are banned by SG MANAGED.

SG MANAGED reserves the right to change the Policy at any time, successful upon posting of the changed Policy to this URL: http://sgmanaged.com/about/aup.php

Note: all payments to SG MANAGED are required, and no compensation will be given.

Use of SG MANAGED Service constitutes acceptance and contract to SG MANAGED's AUP as well as SG MANAGED's TOS (Terms of Service)

RIGHTS OF NEUTELLIGENT: If Users keep in conduct while using the Service that is in infringement of the Policies or is otherwise illegal or unacceptable, we reserve the right to delay and/or terminate the Service or the User's admission to the Service. Mostly, we will effort to inform you of any activity in violation of the Policies and demand that the User cease such activity; on the other hand, in cases where the possibility of the SG MANAGED network is threatened or cases concerning UCE/SPAM, promotion, transmitting, or else making existing any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which comprises, but is not limited to, the facilitation of the means to spam, mail relaying, modification of your source IP address information, refutation of service attacks, illegal activities, harassment or copyright infringement, we preserve the right to suspend your Service or the User's admission to the Service without warning. Adding up, we may take any other proper action, legal or else, against a User for violations of the Policies, which may contain termination of the Service. We do not make any guarantee, nor do we have any responsibility, to monitor or police activity occurring via the Service and will have no responsibility to any party, including you, for any violation of the AUP

VIOLATIONS OF SG MANAGED ACCEPTABLE USE POLICY

Unlawful monitoring of data or traffic on any network or system without express authorization of the holder of the system or network. Interference with service to any user, host or network plus, without limitation, mail bombing, flooding, deliberate attempts to overload a system and show attacks.

Copyright or trademark infringement: Use of the SG MANAGED to spread any material (by e-mail, uploading, posting, hot linking, directly linking or else) that breaks any copyright, brand name, patent, trade secret or other proprietary rights of any third party, together with, but not limited to, the illegal copying of copyrighted material, the digitization and distribution of photographs from periodicals, books, or other copyrighted sources, and the illegal transmittal of copyrighted software.

Collection of personal data: Use of the SGMANAGED to collect, or effort to collect, personal information about third parties without their knowledge or permission.

Promotion, transmitting, or otherwise making obtainable any software, program, product, or service that is designed to abuse this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to spam.

EMAIL: Sending unwanted mail messages, as well as, without limitation, profit-making promotion and informational announcements, is explicitly banned. A user shall not use another site's mail server to spread mail without the express agreement of the site.

Distribution of Viruses: planned distributions of software that efforts to and/or causes break, pestering, or irritation to persons, data, and/or computer systems are banned. Such a crime will result in the direct termination of the offending account.

Third Party Accountability: SG MANAGED subscribers will be held accountable and blamed for any activity by third parties, using their account, that violates guiding principle created within the Acceptable Use Policy.

IRC networks: It is absolutely not allowed to host an IRC server that is part of or connected to another IRC network or server. Servers found to be connecting to or part of these networks will be removed without delay from our network without warning. The server will not be reconnected to the network until such time that you agree to absolutely remove any and all traces of the irc server, and agree to let us have admission to your server to verify that the content has been absolutely removed. Any server guilty of a second transgression will result in direct account extinction.

Domains Chargeback Resolution: If the charge for a domain or rest of domains is charged back, SG MANAGED has the right to take control of the domain or rest of domains that was paid for by the disputed charge. SG MANAGED will modify the domain account information as needed to take control of the domain or rest of domains. The user does not guarantee to be contacted in the event that a chargeback is received.

Peer to Peer Software (File Sharing): The use of Peer to Peer or file sharing software to authorize the sharing, copying or distribution of illegal copyrighted material on the SG MANAGED service is banned. Use of such software could effect in delay of service.

UCE/Spamming/Mail bombing A User may not apply the Service to transmit excessive volumes of unwanted profit-making e-mail messages or intentionally send extremely large attachments to one receiver. Any unwanted profit-making e-mail messages or a series of unwanted profit-making e-mail messages or large attachments sent to one receiver, constitutes Unsolicited Commercial E-mail "UCE" and is banned. Adding up, "spamming" or "mail bombing" is also banned. Use of the service of another provider to send UCE, spam or mail bombs, to advertise a site hosted on or related to the NeuTelligent network, is also banned. As well, you may not use the Service to gather responses from mass unwanted e-mail messages.

Spoofing/Fraud A User may not try to send e-mail messages or spread any electronic communications using a name or address of someone other than the User for purposes of fraud. Any effort to imitate someone else by shifting a source IP address information or by using artificial headers or other identifying information is banned. Any effort to illegally conceal, forge, or else fabricate a User's personality in connection with use of the Service is banned.

E-Mail Relay Any use of another party's electronic mail server to spread e-mail without express authorization from such other party is banned.

USENET Postings All postings to USENET groups must accomplish with that group's agreement and other policies. Users are forbidden from cross posting to not related news groups or to any news groups where the post does not meet that group's agreement. Continued posting of off-topic messages, as well as commercial messages (unless specifically invited by charter), is forbidden.

Illegal Activity Users agree to use the Service only for legal purposes. Use of the Service for transmission, distribution, retrieval, or storage of any information, facts, or other material in infringement of any appropriate law or directive (as well as, where applicable any tariff or treaty) is banned. This contains, without limitation, the use or transmission of any information or material secluded by copyright, brand name, trade secret, patent, or other intellectual property right without proper permission and the transmission of any material that constitutes a prohibited threat, violates export control laws, or is obscene, insulting, or otherwise criminal.

Cooperation with Investigations We will work together with proper law enforcement agencies and other parties involved in investigating claims of unlawful or unsuitable doings.

Privacy Because the Internet is an essentially open and insecure means of communication, any facts or information a User transmits over the Internet may be compliant to interception and modification. Subject to our On-line Privacy Policy, we make no guarantee concerning, and assume no responsibility for, the safety and integrity of any fact or information a User transmits by the Service or over the Internet, as well as any fact or information transmitted by any server designated as "protected."

Accounts with negative balance can be suspended at once after the termination of the paid period; also all unpaid hosting accounts will be deleted during 15 days after the termination of the paid period. Dedicated servers unpaid for more then 15 days are subject to disconnection.

Any account found in violation of our policy may be terminated without refund.

In case the client wishes to break off the agreement with SG MANAGED he is obliged to warn the company not later than 15 days before the termination of the paid period.

Traffic is counted in mbit per second, 10 mb/s = 3300 GB/m.
